These Terms and Conditions govern your use of posthours.com and any services provided by PostHours. By accessing our website or engaging our services, you agree to be bound by these terms. If you do not agree, please do not use our website or services.

We may update these terms periodically. The most recent Effective Date will always be shown at the top of this page. Continued use of our website or services after an update constitutes acceptance of the revised terms.

About Our Services

PostHours builds and manages fully automated AI lead capture systems for multi-location service businesses in the United States. Our services include:

  • Setting up and managing missed call text back systems
  • AI voice receptionists
  • WhatsApp and Instagram DM automation
  • Google Business message responses
  • Web form follow-up sequences
  • Facebook Messenger automation

All systems are configured, monitored, and maintained by PostHours on behalf of the client. Clients receive weekly performance reports and a monthly strategy call. All services are delivered remotely. Scope, timelines, and deliverables for each engagement are agreed upon in writing before work begins.

Eligibility

Our services are intended for business owners and operators of multi-location service businesses. By booking a demo or engaging our services, you confirm that:

  • You are at least 18 years of age
  • You have the legal authority to enter into a service agreement on behalf of your organisation
  • Your business operates lawfully in the United States

Booking and Demos

Free demo calls are available through our booking page accessible at posthours.com. Our website also offers a free missed call revenue calculator and a live demo experience. By using these tools or booking a demo, you agree to:

  • Provide accurate information about your business
  • Attend the scheduled call at the agreed time or provide reasonable notice if you need to reschedule
  • Acknowledge that a demo or calculator result does not constitute a binding service agreement or guarantee of specific results

During the booking process and calculator flow you may be presented with an SMS consent option. Providing your phone number or checking a consent checkbox indicates your explicit consent to receive SMS communications from us related to your demo or inquiry. Consent is entirely voluntary and never a condition of using our website or booking a call. You may opt out at any time by replying STOP.

Live Demo Experience

Our website and calculator page offer a live demo experience where visitors can call our demo number and hear an AI voice agent respond. By calling our demo number, you consent to:

  • The call being handled by an automated AI system
  • The collection of your calling number for the purpose of sending you a follow-up demo SMS
  • Receiving one automated SMS message after the call ends demonstrating our missed call text back capability

You may opt out of further SMS communications at any time by replying STOP.

Service Agreements

Paid services are governed by a separate written service agreement signed by both parties. That agreement will specify the exact scope of work, deliverables, timelines, payment terms, and any other terms specific to your engagement. In the event of any conflict between these Terms and Conditions and a signed service agreement, the service agreement takes precedence.

Payment Terms

Our standard payment model includes a one-time setup fee and a monthly retainer as described on our website. Specific payment amounts, due dates, and accepted payment methods are outlined in your service agreement. All fees are non-refundable unless otherwise stated in writing or covered by our service guarantee. We reserve the right to pause or terminate services if payment is not received by the agreed due date.

Service Guarantee

PostHours offers a 30-day performance guarantee. If our system does not capture and respond to at least 90% of your missed calls within 60 seconds during the first 30 days of service, you are entitled to a full refund of your setup fee.

This guarantee:

  • Applies to the missed call text back functionality only
  • Is subject to the system being properly configured and the client's phone infrastructure being correctly set up as agreed during onboarding
  • Does not apply if service performance is affected by factors outside our control including carrier outages, incorrect call forwarding configuration on the client's side, or changes to the client's phone system without notifying PostHours

Intellectual Property

All content on posthours.com including text, graphics, logos, and images is the property of PostHours and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without prior written permission.

AI-generated content, automation workflows, and system configurations created specifically for a client as part of a paid engagement become the property of the client upon full payment unless otherwise agreed in writing.

Client Responsibilities

To enable effective delivery of our services, clients agree to:

  • Provide accurate and complete information about their business, locations, booking systems, and customer communication channels
  • Set up call forwarding on their existing phone numbers as instructed during onboarding
  • Respond to requests for approvals and feedback in a timely manner
  • Ensure that any existing customer data provided to us was obtained lawfully and with appropriate consent
  • Comply with all applicable laws and regulations related to their own customer communications

We are not responsible for outcomes resulting from inaccurate information provided by the client, failure to set up call forwarding correctly, or failure to meet these responsibilities.

Compliance and Lawful Use

You agree to use our services in compliance with all applicable laws including the Telephone Consumer Protection Act, the CAN-SPAM Act, and any applicable state or federal regulations governing SMS, voice, and digital communications. You agree not to:

  • Send unsolicited communications to individuals who have not consented
  • Make false or misleading claims to your customers
  • Violate the terms of service of any platform used as part of your lead capture system
  • Conduct any activity that is unlawful, harmful, or fraudulent

We reserve the right to terminate services immediately and without refund if a client engages in unlawful or non-compliant activity.

SMS Communications

By opting in to receive SMS communications from us through our website, calculator, booking page, or demo experience, you consent to receive text messages related to your demo, inquiry, or active service engagement.

Carriers are not liable for delayed or undelivered messages. We do not send unsolicited bulk SMS. All SMS communications are sent only to individuals who have explicitly opted in.

Third-Party Platforms and Services

Our services involve the use of third-party platforms including AI voice providers, SMS delivery platforms, WhatsApp Business API, Instagram messaging, Google Business APIs, automation software, and calendar tools. We are not responsible for changes to the terms, policies, availability, or functionality of any third-party platform that may affect your lead capture system. It is your responsibility to ensure your use of any platform complies with that platform's terms of service.

Limitation of Liability

To the fullest extent permitted by law, PostHours shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or services, including but not limited to lost revenue, lost leads, lost data, or business interruption.

Our total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim in the 30 days preceding the claim.

Disclaimer of Warranties

Our website and services are provided on an as-is basis without warranties of any kind, express or implied. We do not guarantee specific lead volumes, booking rates, or revenue outcomes from our AI lead capture systems. Results depend on factors outside our control including:

  • The volume and quality of inbound traffic to your business
  • Your pricing and offer
  • Your booking calendar availability
  • Market conditions in your area

Termination

Either party may terminate a service engagement with written notice as specified in the relevant service agreement. We reserve the right to terminate access to our website or services at any time if these terms are violated.

Upon termination:

  • All outstanding fees become immediately due
  • Any work completed up to the termination date remains billable
  • We will provide the client with access to any data or configurations belonging to them within 14 days

Governing Law

These Terms and Conditions are governed by the laws applicable to your jurisdiction as a client. For clients based in the United States, any disputes shall be resolved in accordance with applicable US federal and state law. We operate internationally and aim to comply with all relevant legal frameworks in the jurisdictions where our clients are located.

Changes to These Terms

We may update these Terms and Conditions at any time. Updates will be posted on this page with a revised Effective Date. Continued use of our website or services after an update constitutes acceptance of the revised terms.
